This CintaCinta.id User Service Agreement (the "Agreement") is entered into between you (the "User") and the operator of the CintaCinta.id platform ("Platform" or "we/us") regarding your access to, registration for, login to, and use of the CintaCinta.id mobile application, official website, and related services.

Before you click "Agree," complete registration/login, or otherwise use the services, please carefully read and fully understand all terms of this Agreement, especially provisions concerning limitation of liability, disclaimers, dispute resolution, and account handling. By performing any of the foregoing actions, you are deemed to have read, understood, and agreed to be bound by this Agreement and its subsequent updates.

Article 1 Definitions

  • CintaCinta.id Services: Social interaction and related functional services provided by the Platform through the app, website, APIs, and associated technical systems.
  • User Content: All information and content uploaded, published, transmitted, stored, or otherwise provided by the User, including but not limited to avatar, nickname, cover image, profile introduction, moments, comments, chat messages, voice, images, and videos.
  • Account: The identity credential created on the Platform and used for login/use through methods such as Email OTP, WhatsApp OTP, or authorized third-party login.
  • Third-Party Services: Capabilities or components independently provided by third parties and integrated with the Platform, including location, push notifications, third-party login, audio/video capability, and cloud infrastructure.
  • Applicable Law: Effective laws, regulations, supervisory rules, and judicial interpretations applicable in the user’s jurisdiction and the service operation jurisdiction.

Article 2 Scope and Hierarchy of Effect

  • This Agreement applies to all user access and use of CintaCinta.id services.
  • Rules, announcements, policies, guidelines, product descriptions, and feature notices related to the services form an integral part of this Agreement and have equal legal effect.
  • If this Agreement conflicts with specific service rules, the specific service rules shall prevail for that specific matter unless otherwise expressly provided.

Article 3 User Eligibility and Compliance Commitments

The User confirms and undertakes that the User has reached the legal age under applicable law and is not younger than 18; has full civil rights and capacity to sign and perform this Agreement; and is not prohibited by law from using the services. The User shall use authentic, lawful, and valid identity information and shall not impersonate others. The Platform may verify user eligibility and take necessary management measures for compliance, risk control, and security purposes.

Article 4 Account Registration, Use, and Security

  • Users may register/login through supported methods, including Email OTP, WhatsApp OTP, and third-party authorized login.
  • Users are legally responsible for all activities under their accounts. Losses caused by improper account custody (including theft, misuse, or leakage) shall be borne by the user.
  • Users shall not conduct or assist account trading, leasing, lending, sharing, bulk registration, or malicious account farming.
  • If account abnormalities, suspected intrusion, or security risks are detected, users shall promptly notify the Platform and cooperate in verification and handling.
  • The Platform may implement verification, restrictions, freezing, suspension, or cancellation of accounts where necessary.

Article 5 Service Content and Functional Adjustments

The Platform currently provides (subject to actual deployment): profile management; nearby matching; private chat (text/image/voice); real-time cross-language translation; City Room chat; moments posting and interaction; audio/video interaction; image optimization (including AI enhancement); and notification/system messaging. The Platform may add, modify, restrict, suspend, migrate, or discontinue functions for operational, compliance, technical, or security reasons. Users acknowledge that certain functions may be affected by network conditions, device model, system permissions, regional policy, and third-party service availability.

Article 6 User Content and License Authorization

  • Users warrant that submitted content is lawful, truthful, complete, and does not infringe third-party rights.
  • Users bear legal liability arising from their content and shall compensate the Platform or third parties for resulting losses as required by law.
  • For service implementation, users grant the Platform a necessary global, non-exclusive, transferable, sublicensable license to copy, store, process, display, distribute, adapt (technical adaptation), translate, and review user content.
  • Such authorization is limited to service provision and optimization and does not alter users’ lawful ownership rights in their content.

Article 7 Code of Conduct and Prohibited Acts

Users shall not, including but not limited to: publish illegal/violent/pornographic/hate/terror/rumor/harassing/defamatory content; conduct fraud, false identity inducement, extortion, illegal traffic diversion, gambling, or money laundering; interfere with platform operation via scripts, plugins, crawlers, reverse engineering, or exploit abuse; illegally collect/sell/exchange/leak others’ personal data; record or distribute others’ chat/audio-video/private content without permission; infringe third-party IP, personality, or lawful rights; or otherwise violate laws, public order, morality, or platform rules. The Platform may independently adopt graded measures, including warning, deletion, traffic restriction, mute, suspension, termination, and legal pursuit.

Article 8 Special Clauses: Translation, Audio/Video, Local Interaction

  • Translation: Automatically generated translations may contain semantic deviation, delay, or incompleteness and do not constitute professional legal, medical, or financial advice.
  • Audio/Video: Users shall comply with applicable recording and privacy laws; recording, distribution, or commercial use without explicit consent is prohibited.
  • Nearby/Local capabilities: Display results are based on system strategy and geodata and may include errors or latency; no absolute accuracy is warranted.

Article 9 Third-Party Service Integration

The Platform may integrate third-party services and SDKs for location, push, login, and audio/video functions. Third-party services are independently provided and governed by their own terms and privacy policies. For availability impacts caused by third-party faults, upgrades, interruptions, or policy changes, the Platform will assist within reasonable scope but bears no liability beyond statutory obligations.

Article 10 Privacy and Data Processing

Personal information processing is governed by the Privacy Policy, which is an inseparable part of this Agreement. The Platform adopts reasonable and necessary technical and administrative safeguards. Users understand that absolute security cannot be guaranteed under current technology and risk conditions. Users may exercise rights such as access, correction, deletion, and permission withdrawal according to the Privacy Policy and platform functions.

Article 11 Account Deletion and Service Termination

Users may initiate account deletion via platform-provided channels. Upon confirmation, the Platform will perform irreversible deletion or anonymization according to system processes unless otherwise required by law. The Platform may suspend, restrict, or terminate services where users seriously breach this Agreement/platform rules, are suspected of illegal conduct, where required by regulation/judicial/compliance demands, or where necessary for platform/public security and stability. Account handling does not affect legal pursuit of prior liabilities.

Article 12 Intellectual Property

Intellectual property in platform programs, architecture, pages, texts/images, identifiers, databases, and related technical achievements belongs to the Platform or right holders. Without prior written consent, users shall not copy, adapt, translate, decompile, reverse engineer, distribute, or commercially exploit platform content/technology. Rights holders may submit infringement notices through announced channels for lawful handling.

Article 13 Disclaimer

Services are provided on an "as is" and "as available" basis, without express or implied warranties regarding continuity, timeliness, completeness, or accuracy. For losses caused by force majeure, network failure, system maintenance, cyberattack, or third-party service anomalies, the Platform bears no liability beyond statutory duties within the scope permitted by law. Risks in offline contact/transactions between users are borne by users themselves.

Article 14 Limitation of Liability and Indemnification

To the extent permitted by applicable law, the Platform is not liable for indirect, incidental, punitive, profit, or data losses. If user breach causes claims, penalties, or losses to the Platform, affiliates, or third parties, the user shall fully indemnify and hold the Platform harmless. Mandatory statutory caps or rules shall prevail where applicable.

Article 15 Agreement Changes, Notice, and Service of Notice

The Platform may update this Agreement due to legal/regulatory changes, supervisory requirements, or business adjustments. Material changes will be notified via in-app notice, pop-up, push message, or other reasonable means. Continued use after effectiveness constitutes acceptance of the updated Agreement. Notices sent to account-bound channels or posted in-app/onsite shall be deemed validly served.

Article 16 Governing Law and Dispute Resolution

The conclusion, validity, interpretation, performance, and dispute handling of this Agreement shall be governed by the laws of the Republic of Indonesia (excluding conflict-of-law rules). Any dispute arising out of or related to this Agreement shall first be resolved through amicable consultation; failing that, either party may submit to a competent court or other legally agreed dispute resolution forum.

Article 17 Miscellaneous

  • If any provision is held invalid or unenforceable, the remaining provisions remain effective.
  • Failure or delay by the Platform to exercise any right shall not constitute waiver.
  • Headings are for convenience only and do not affect interpretation.
